Waltham Forest Council Housing repossession failed

I observed a civil case in the housing department at the Stratford Magistrate court today. I am not an expert in civil law, but what I witnessed today must be shared with everyone.

A female was taken to court for having rent arrears of £360. Waltham Forest Council tried to repossess her Council Property. The Council sent baililfs to repossess the property. The defence raised a suspension on the order, the judge granted the suspension and ordered the female to pay an extra £30 towards her standard rent until arrears are clear. The officer who represented Waltham Forest Council asked for the defendant to pay the bailifts charge. The judge asked the officer why should the defendant pay for the bailifts. This was also rejected.

I just want to say that the actions taken by the Waltham Forest Council were excessive and a more civil resolution should have been agreed between the Council and the tenant. Yes, there are shortages of Council properties, but this has been an issue for decades, its nothing new. And I don't want anyone to think that they now have to worry that they properties will be repossessed if they fall behind rent arrears.If you are behind rent arrears and are in fear that Council will ask for a repossession based on unreasonable grounds-do not panic, seek advice from either CitizenshipAdvice Housing (1) or an independent solicitor firm, but only after you have attempted to resolve the rent arrears with your local housing.
